1. Provider and Scope
1.1. These Terms of Service govern the use of the website and electronic platform Jobche.eu, provided by "Jobche" EOOD, UIC 208901386, with registered seat and management address: Sofia, postal code 1715, Mladost district, Mladost 4 residential complex, Filip Avramov Str., bl. 411, entrance 5, floor 3, apt. 9, represented by Martin Viktorio Pavlov ("Jobche", "the Platform", "we").

1.3. Users of the Platform are: (a) visitors; (b) individuals who browse job listings and may submit an application ("Candidates"); and (c) employers, companies, or their duly authorized representatives, who post job listings and manage applications ("Employers").
1.4. By registering, placing an order, or using a feature that requires acceptance, the user confirms these Terms of Service.
2. Nature of the Service — a Software Platform, Not a Recruitment Service
2.1. Jobche provides electronic and software infrastructure through which Employers can post job listings and Candidates can browse them and, at their own discretion, submit an application. When an application is submitted through the Platform, Jobche performs a technical function of receiving, storing, and delivering the application to the specific Employer chosen by the Candidate.
2.2. Jobche does not perform individual personnel selection and does not participate in the hiring decision. Specifically, Jobche:
- does not assess, verify, or certify a Candidate's professional qualities, experience, qualifications, or suitability for a specific position;
- does not rank, shortlist, or recommend Candidates to Employers;
- does not determine which Employer a Candidate applies to and does not send an application to a recipient the Candidate has not chosen;
- does not organize interviews, conduct negotiations, or communicate on behalf of the Candidate or the Employer;
- does not determine or negotiate salary, working hours, place of work, or other employment conditions;
- is not a party to an employment or other contract between the Candidate and the Employer and does not guarantee its conclusion;
- does not receive compensation contingent on whether a particular Candidate is hired.
2.3. The search engine, filters, sorting, and notifications use objective parameters of the listings and criteria set by the user. They do not constitute an individual professional recommendation or suitability assessment.
2.4. The Employer independently conducts the entire selection process and is responsible for communication, interviews, evaluation, hiring decisions, and the lawfulness of the employment relationship.
3. Services for Candidates
3.1. Candidates may browse and search listings free of charge. Where the relevant features are available, they may create a profile, save listings, upload a CV, manage their applications, and receive voluntary notifications based on selected criteria.
3.2. Registration is intended for individuals who have reached 18 years of age. The Platform is not intended for independent registration by individuals under 18.
3.3. The Candidate is responsible for the accuracy of their data and documents and should not include unnecessary data such as a national ID number, ID card number, bank details, health information, religion, political beliefs, or other sensitive data, unless expressly necessary for a specific lawful stage.
4. Applying Through Jobche
4.1. Before an application is sent, the Platform displays the specific listing, the Employer, and the data/files that will be provided.
4.2. An application is sent only after an explicit action by the Candidate — for example, clicking the "Send Application" button. Jobche does not automatically send a CV to other Employers.
4.3. Once the application has been delivered to the Employer's account or through another agreed technical channel, the Employer independently determines the selection process actions and is responsible for the subsequent processing of the data for its own purposes.
4.4. The Candidate may replace or delete their CV from their own profile. This does not automatically erase a copy that has already been lawfully received by an Employer and is processed in a system that Jobche does not control.
5. Applying on an External Site
5.1. Some listings may contain a link to the Employer's website or another external site. In such cases, the Candidate leaves Jobche and provides their data directly to the external operator.
5.2. Jobche does not control the external site and is not responsible for its availability, content, terms, or processing of personal data. The Candidate should review the documents of the respective site.
6. Employer Accounts and Verification
6.1. The Employer provides accurate company data and confirms that the person managing the account has the right to act on behalf of the stated organization.
6.2. For security, fraud prevention, and user protection, Jobche may verify the company registration, official contact, domain, and representative authority, and may request additional evidence.
6.3. The verification has a limited purpose — identification and prevention of abuse. It does not constitute approval or a guarantee of the Employer's financial standing, working conditions, future conduct, or the lawfulness of any action by the Employer.
6.4. Jobche may not activate, or may temporarily restrict, an Employer account until the necessary verification is completed.
7. Job Listings
7.1. The Employer is solely responsible for the text, accuracy, currency, and lawfulness of the listing and for having the right to publish it.
7.2. A listing must not be fraudulent, misleading, discriminatory, or unlawful, must not require unjustified personal data, must not contain malicious links, and must not present an investment or commercial scheme as an employment position.
7.3. It is prohibited for a listing to request, as a condition for applying or being hired, payment, a deposit, purchase of a product, provision of bank access, or another unusual financial transaction from a Candidate.
7.4. The Employer is obligated to promptly update or take down a listing when the position is no longer open or the material terms have changed.
7.5. Jobche may perform technical formatting and moderation for compliance with these rules, but does not verify or certify the professional or employment conditions on behalf of the Employer.
8. External and Imported Listings
8.1. The Platform may display listings obtained from an Employer, a contracted data feed, or another lawful source. When the application is external, this is clearly indicated.
8.2. Jobche shall not copy content in violation of third-party rights or the terms of the source. Upon a well-founded request from an entitled party, the listing may be corrected or removed.
9. Plans and Pricing for Employers
9.1. Current prices and plan features are displayed on the pricing page and immediately before ordering. As of 24.08.2026, the following are provided:

9.2. Unused credits under the single listing/package are valid for up to 365 days, unless otherwise stated at the time of purchase. The stated prices are exclusive of VAT.
9.3. If the plan is subscription-based, the period, price, automatic renewal, next payment date, and cancellation method are displayed before payment.
9.4. The Employer may cancel future automatic renewal up to 1 day before the next payment date via the payments menu or another mechanism shown in the account. Cancellation does not affect the already-paid period.
10. Payment via Stripe and Invoicing
10.1. Card payments are processed via Stripe. Card details should be entered into Stripe's secure payment components, so that Jobche does not store the full card number or security code.
10.2. The paid service is activated upon confirmation of successful payment. In the event of a declined, disputed, or cancelled payment, Jobche may suspend activation or access to the respective paid feature pending clarification.
10.3. The invoice is provided via Stripe. The Employer is responsible for entering accurate billing information.
11. Refunds
11.1. The paid service grants the right to publish and access to the agreed software features, not a guarantee of a certain number of applications or hiring. The absence of applications alone does not give rise to a right to a refund.
11.2. If Jobche is unable to provide the paid core feature for a reason for which it is responsible, it may extend the term, restore a credit, or refund a proportional part of the price depending on the specific case.
11.3. When a listing is removed due to a violation of the law or these Terms, the used credit is generally not refunded, unless the decision is overturned.
12. Content and Rights
12.1. The user retains the rights to the content they provide, but grants Jobche a limited, non-exclusive, and royalty-free right to store, format, display, and technically transmit it only to the extent necessary to provide the service.
12.2. The Employer warrants that it has the right to use the text, logo, images, and other materials in the listing.
12.3. Candidate materials are used solely to provide the features requested by the Candidate and are not made available to another Employer without a separate action or another valid legal basis.
12.4. The design, source code, databases, trademarks, and original content of Jobche are protected. Mass automated extraction, copying, or creation of a competing database beyond what is permitted by law is prohibited.
13. Reports, Illegal Content, and Moderation
13.1. Anyone may submit a report regarding a specific listing, profile, or content via the available form or at martin@jobche.eu. The report should identify the specific content or link and the reason it is considered illegal or in violation of the rules.
13.2. Jobche may request additional information, temporarily restrict the content, remove it, warn the user, or restrict the account, where this is justified and proportionate.
13.3. Where applicable, the affected user receives information about the key facts and the grounds for the decision and the opportunity to object, unless the law or security considerations do not permit this.
13.4. In processing reports and restrictions, Jobche applies the applicable requirements of Regulation (EU) 2022/2065 on digital services, in accordance with the provider's role and size.
14. Restriction and Termination of an Account
14.1. The user may terminate their profile via the settings or by request to Jobche.
14.2. Jobche may temporarily or permanently restrict a profile in the event of a violation of the law or the Terms, false data, abuse, fraud, security risk, non-payment, or an order from a competent authority.
14.3. In the case of a remediable violation, a reasonable opportunity for correction is generally provided, except in cases of urgent risk, fraud, or a serious violation.
14.4. In the event of 12 months of inactivity, Jobche may send a warning and, 30 days later, close the inactive profile, unless there is a reason to continue it.
15. Availability of the Service
15.1. Jobche makes reasonable efforts to ensure functionality and security but does not guarantee uninterrupted or error-free operation. Interruptions are possible due to maintenance, security, an external provider, or force majeure.
15.2. Jobche may develop its features without depriving the Employer, without an appropriate remedy, of an already-paid core service.
16. Liability
16.1. The Employer is responsible for the listing, the selection process, communication, evaluation, hiring decisions, the employment contract, and the fulfillment of its obligations as an employer.
16.2. The Candidate is responsible for the accuracy of the data and documents they provide and for their own decision to apply or accept an offer.
16.3. Jobche does not guarantee the identity, financial standing, working conditions, or future conduct of the Employer, nor the qualifications or conduct of the Candidate, beyond the specific checks the Platform has expressly indicated.
16.4. To the extent permitted by law, Jobche is not liable for indirect damages or lost profits. For a paid service to an Employer, the total contractual liability for ordinary negligence is limited to the amount paid for the affected service over the last 12 months. This limitation does not apply in cases of intent, gross negligence, or where the law does not permit such limitation.
17. Personal Data
17.1. Processing by Jobche is described in the Privacy Policy.
17.2. The Employer is an independent controller for its own selection purposes after receiving the application. For limited technical operations in the Employer panel, in which Jobche processes data solely on the Employer's instructions, the relationship may be governed by an agreement under Art. 28 GDPR.
18. Notices and Changes
18.1. Official notices regarding the profile, applications, security, payment, or document changes may be sent to the email address in the profile.
18.2. Notifications about new listings are voluntary and may be stopped at any time.
18.3. In the event of a material change to the Terms, registered users are notified in an appropriate manner. A new version does not apply retroactively to an already-completed order.
18.4. Last updated: 24.08.2026. Upon request, users may obtain information about the previous version of the Terms of Service by contacting us at martin@jobche.eu.
19. Governing Law and Disputes
19.1. The law of the Republic of Bulgaria applies, without prejudice to non-waivable rights applicable by law.
19.2. The parties shall make efforts to settle disputes amicably. Failing that, the dispute shall be resolved by the competent Bulgarian court, and between merchants — by the competent court in Sofia, to the extent such local jurisdiction may be agreed upon.
20. Final Provisions
20.1. If an individual clause is invalid, the remaining clauses shall remain in effect.
20.2. These Terms of Service have been adopted by the manager of "Jobche" EOOD and are effective as of 24.08.2026.
